Article 2(6)
1.—(1) Amend the Intestate Succession (Interest and Capitalisation) Order 1977(1) as follows.
(2) In article 3(1), (2) and (3), after “surviving spouse” insert “or civil partner”.
(3) In Table 1 in the Schedule to the Order—
(a)after “a surviving husband” insert “or a surviving male civil partner”; and
(b)after “age last birthday of husband” insert “or civil partner”.
(4) In Table 2 in the Schedule to the Order—
(a)after “a surviving wife” insert “or a surviving female civil partner”; and
(b)after “age last birthday of wife” insert “or civil partner”.
2.—(1) Amend the Non-Contentious Probate Rules 1987(2) as follows.
(2) In rule 22(1)(a), for “husband or wife” substitute “spouse or civil partner”.
(3) In rule 22(4), after “a spouse” insert “or a civil partner”.
(4) In the heading to rule 56 and in rule 56(1), after “surviving spouse” insert “or civil partner”.
(5) In Form 6 in Schedule 1 to the Rules, after “wife/husband” insert “/civil partner”.
