This regulation and regulations 1B to 1D are without prejudice to the duties of the F8... design court under the provisions of Article 89(1)(a) to (c) of the F8... Design Regulation.

F2Subject to F3paragraph (5), in an action for infringement of a F4supplementary unregistered design all such relief by way of damages, injunctions, accounts or otherwise is available to the holder of the F4supplementary unregistered design as is available in respect of the infringement of any other property right.

In an action for the infringement of F6a supplementary unregistered F7... design, damages shall not be awarded against a person who proves that at the date of the infringement that they were not aware, and had no reason to believe, that the design to which the action relates was protected as F6a supplementary unregistered F7... design.
