The period prescribed for the purposes of section 16(1)6 shall be—

a

where there is no declared priority date, the period of 18 months beginning with the date of filing of the application; or

b

where there is a declared priority date, the period of 18 months beginning with that date.

Where a person’s application under rule 15A(1)(a) or (b) has been accepted by the comptroller, the comptroller shall ensure that the application for the patent as published under section 16 does not mention his name and address as those of the person believed to be the inventor (or, as the case may be, his address as that of the person so believed).
