Amendment of the Social Fund Winter Fuel Payment Regulations 20008

The Social Fund Winter Fuel Payment Regulations 2000 M1 shall be amended in accordance with this regulation.

In regulation 1 (citation, commencement and interpretation)—

a

in paragraph (2)—

i

omit the definitions of “nursing home” and “residential accommodation”;

ii

at the appropriate places insert the following definitions— “care home” in England and Wales has the meaning assigned to it by section 3 of the Care Standards Act 2000 M2, and in Scotland means a care home service as defined by section 2(3) of the Regulation of Care (Scotland) Act 2001 M3; ”

“independent hospital” has the meaning assigned to it by section 2 of the Care Standards Act 2000, and in Scotland means an independent healthcare service as defined in section 2(5)(a) and (b) of the Regulation of Care (Scotland) Act 2001;

b

in paragraph (3) M4—

i

omit “Subject to paragraph (3A),”;

ii

in sub-paragraph (a) for heads (i) to (iii) substitute—

i

a care home;

ii

an independent hospital; or

c

omit paragraph (3A).
