Transitional provision11
Where—
a
there are proceedings before the court in respect of a civil partnership which are continuing;
b
that civil partnership is treated as having been formed by virtue of section 215(1) of the Civil Partnership Act 2004; and
c
the overseas relationship by reference to which the parties are treated as having formed the civil partnership was registered before 5th December 2005,
then rule 3 applies to those proceedings as though the reference to the parties having lived together after the formation of the civil partnership is a reference to their having lived together after the registration of the overseas relationship.
