The Criminal Justice and Court Services Act 2000 (Commencement No. 15) Order 2005

The Secretary of State makes the following Order in exercise of the powers conferred by section 80 of the Criminal Justice and Court Services Act 20001:

This Order may be cited as the Criminal Justice and Court Services Act 2000 (Commencement No. 15) Order 2005.

Section 57 of the Criminal Justice and Court Services Act 2000 (testing persons in police detention) shall come into force on 1st December 2005 to the extent not already in force.

Article 2 of this Order brings section 57 (testing persons in police detention) of the Criminal Justice and Court Services Act 2000 (“the 2000 Act”) into force on 1st December 2005 to the extent not already in force. Section 57 of the 2000 Act inserts sections 63B and 63C into the Police and Criminal Evidence Act 1984 (“PACE”) (c. 60) and amends sections 38 and 66 of that Act. Sections 38 and 63B of PACE are amended by section 5 of the Criminal Justice Act 2003 (c. 44) and will be amended by the Drugs Act 2005 (c. 17).
