3. A Relevant Body may only enter into an agreement if the conditions set out in—
(a)regulation 4; and
(b)in the case of an agreement to be entered into with a qualifying body M1, on or after the coming into force for all purposes of article 39 of the Dentists Act Order (substitution of sections 43 and 44), regulation 5,
are met.
