The Secretary of State, in exercise of the powers conferred by section 144(3)(b) and (14) of the Transport Act 2000(1), makes the following Order:
1. This Order may be cited as the Bus Lane Contraventions (Approved Local Authorities) (England) (Amendment) Order 2005 and shall come into force on 9th January 2006.
2.—(1) The Schedule to the Bus Lane Contraventions (Approved Local Authorities) (England) Order 2005(2) shall be amended as follows.
(2) After the item in the table relating to East Sussex County Council there shall be inserted the following item—
“Elmbridge Borough Council | S.I. 2005/3406” |

This Order amends the Bus Lane Contraventions (Approved Local Authorities) (England) Order 2005 by adding Elmbridge Borough Council to the list of local authorities which are “approved local authorities” for the purposes of section 144 of the Transport Act 2000 (civil enforcement of bus lane contraventions).
No Regulatory Impact Assessment has been undertaken, since the Order is concerned with the enforcement of existing traffic restrictions and prohibitions and does not therefore constitute an additional burden on business. The costs incurred by local authorities undertaking enforcement are expected to be defrayed by penalty charge income.
