The Education (Information as to Provision of Education) (England)(Amendment) Regulations 2005

Coming into force

In exercise of the powers conferred on the Secretary of State by Section 29(3) and 569(4) of the Education Act 19961, the Secretary of State for Education and Skills hereby makes the following Regulations:—

Citation and commencement1

These Regulations may be cited as the Education (Information as to Provision of Education) (England)(Amendment) Regulations 2005 and shall come into force on 1st April 2005.

Amendment of Education (Information as to Provision of Education) (England) Regulations 1999

The Education (Information as to Provision of Education) (England) Regulations 1999 2 shall be further amended as follows.

In Regulation 2 the definitions of “capacity”, “relevant areas of the school premises”, “teaching accommodation” and “washroom facilities” shall be omitted.

Regulation 3(2) shall be omitted.

In paragraph 6 of Schedule 1 for sub-paragraph (c) there shall be substituted the following sub-paragraph

c

any proposals in respect of schools in the area published pursuant to any enactment, which have been approved (where approval is required) or, as the case may be, determined to be implemented, but not implemented;

Part Π of Schedule 1 shall be omitted.

These Regulations further amend the Education (Information as to Provision of Education)(England) Regulations 1999.

The effect of the amendments made by regulations 4 and 6 is that local education authorities will no longer be required to provide information about wheelchair access in schools. The other amendments remove obsolete definitions and make a minor change to Part 1 of Schedule 1.
