The Children Act 2004 (Commencement No. 5) Order 2005

The Secretary of State for Education and Skills makes this Order in exercise of the powers conferred by section 67(2) of the Children Act 2004(1):

Citation, interpretation and application

1.—(1) This Order may be cited as the Children Act 2004 (Commencement No. 5) Order 2005.

(2) In this Order “the Act” means the Children Act 2004.

(3) This Order applies to England.

Provision coming into force

2.  Section 12 of the Act shall come into force on 1st January 2006.

Explanatory Note

(This note is not part of the Order)

This Order is the fifth Commencement Order made under the Act.

The Order brings section 12 of the Act into force. Section 12 concerns the establishment and operation of databases containing information in respect of persons to whom arrangements under section 10 or 11 of the Act, or under section 175 of the Education Act 2002(2), relate.
