The Merchant Shipping (Fees) (Amendment) Regulations 2005

The Secretary of State for Transport, in exercise of the powers conferred upon him by section 302 of the Merchant Shipping Act 19951 and with the consent of the Treasury, hereby makes the following Regulations:

Citation and commencement1

These Regulations may be cited as the Merchant Shipping (Fees) (Amendment) Regulations 2005 and shall come into force on 1st April 2005.

Amendments to the Merchant Shipping (Fees) Regulations 19962

The Merchant Shipping (Fees) Regulations 19962 are amended as follows.

In regulation 5(2), for the words following “the hourly rate of” there is substituted “£36”.

In the Schedule, in Part I—

a

in paragraph 2(2)(a), for the words following “the hourly rate of” there is substituted “£36”; and

b

in paragraph 2(2)(b) for “£50” there is substituted “£75”.

In Part XII, for the table there is substituted:

These Regulations make minor amendments to the Merchant Shipping (Fees) Regulations 1996 by increasing the hourly rate for fees for the issue of certificates pursuant to the Radio Rules(i.e. the statutory instruments relating to radio installations and navigational equipment on merchant ships and fishing vessels). Other fees listed in the table in Part XII of the Schedule are unchanged.

In the case of certificates issued pursuant to the Radio Rules, where a survey was performed abroad by a locally appointed surveyor, the hourly rates applicable to work involving the issue of a certificate are increased from £32.00 to £36.00.

The Regulations make increases in the hourly rates charged for services in relation to the Radio Rules by increasing the hourly survey rates of £32.00 to £36.00. They also increase the flat rate charged for administration and other work from £50.00 to £75.00.

The Regulations make changes to certain charges for additional services, under Part XII as follows:
