The Secretary of State, in exercise of the powers conferred by paragraphs 2(1) and 3 of Schedule 3A to the National Lottery etc. Act 1993(1), and having received an application made for the purpose by the National Lottery Charities Board and the New Opportunities Fund, hereby makes the following Order:

Citation, commencement and interpretation

1.—(1) This Order may be cited as the Transformational Grants Joint Scheme (Authorisation) Order 2005 and shall come into force on 1st April 2005.

(2) In this Order—

“the Act” means the National Lottery etc. Act 1993; and

any reference to a joint scheme is to a joint scheme falling within section 25B of the Act(2).

Authorisation of the joint scheme

2.—(1) The Secretary of State hereby authorises the Transformational Grants joint scheme (“the joint scheme”) which is contained in the agreement entered into on 1st December 2004 between the National Lottery Charities Board and the New Opportunities Fund.

(2) The Schedule to this Order (which, pursuant to paragraph 3 of Schedule 3A to the Act, contains a brief description of the nature and purposes of the joint scheme and other particulars of the scheme) shall have effect.

SCHEDULEPARTICULARS OF THE TRANSFORMATIONAL GRANTS JOINTSCHEME

1.  The nature and purposes of the joint scheme are to make grants (to be known as Transformational Grants) for projects concerned or connected with health, education or the environment or to be funded by charitable expenditure (within the meaning of section 44(1) of the Act) which are intended to transform communities, regions or the nation as a whole.

2.  The joint scheme applies to the whole of the United Kingdom.

3.  The maximum amount of money which may be distributed under section 25(1) of the Act under the joint scheme is £140 million (“the scheme amount”). The maximum amount which may be distributed under section 25(1) of the Act in any year is the amount remaining of the scheme amount at the beginning of the year.

4.  The bodies participating in the joint scheme are the National Lottery Charities Board and the New Opportunities Fund.

5.  The money to be distributed under section 25(1) of the Act under the joint scheme is attributable to each of the participating bodies in the following proportions, that is to say—

(a)as to the National Lottery Charities Board, 25 per cent; and

(b)as to the New Opportunities Fund, 75 per cent.

6.  The joint scheme will cease to have effect no later than 31st March 2008.

This Order authorises the Transformational Grants joint scheme. The, scheme is contained in the agreement entered into on 1st December 2004. A brief description of the nature and purposes of the joint scheme, and other details about it, may be found in the Schedule to the Order.
