The Pensions Increase (Civil Service Injury Benefits Scheme) Regulations 2005

Coming into force

The Treasury, in exercise of the powers conferred by section 5(2) and (4) of the Pensions (Increase) Act 19711 and now vested in them2, hereby make the following Regulations:–

Citation and commencement1

These Regulations may be cited as the Pensions Increase (Civil Service Injury Benefits Scheme) Regulations 2005, and shall come into force on 8th April 2005, but shall have effect from 1st October 2002.

Interpretation2

In these Regulations:

  • “the 1971 Act” means the Pensions (Increase) Act 1971;

  • “pension” means a pension within the meaning of the 1971 Act;

  • the scheme” means the Civil Service Injury Benefits Scheme.

Pensions to which the 1971 Act will apply3

The 1971 Act shall have effect in relation to any pensions payable under the scheme (being a scheme under section 1 of the Superannuation Act 19723 made by virtue of section 2(2) of that Act) as if they were pensions specified in Part I of Schedule 2 to the 1971 Act.

Revocation4

The Pensions Increase (Civil Service Injury Benefits Scheme) Regulations 20044 are hereby revoked.

These Regulations apply the provisions of the Pensions (Increase) Act 1971 to any pension payable under the Civil Service Injury Benefits Scheme. The rate of any such pension is thereby increased annually in accordance with the Retail Prices Index. They revoke the Pensions Increase (Civil Service Injury Benefits Scheme) Regulations 2004.
