Coming into force

The Secretary of State for Transport makes this Order in exercise of powers conferred by sections 10 and 12 of the Highways Act 19801 and now vested in him2, and of all other powers enabling him in that behalf:

This Order may be cited as the A30 Trunk Road (Bodmin to Indian Queens Improvement and Slip Roads) (Detrunking) Order 2005 and shall come into force on 17th January 2005.

In this Order—

i

“classified road” as a classification for a highway, means that the highway is not a principal road for the purposes of enactments or instruments which refer to highways classified as principal roads but is a classified road for the purpose of every enactment and instrument which refers to highways classified by the Secretary of State and which does not specifically refer to their classification as principal roads;

ii

“the new trunk roads” 3means the new highways which the Secretary of State proposes to construct referred to in article 2(2)(ii) of the A30 Trunk Road (Bodmin to Indian Queens Improvement and Slip Roads) Order 200 ; and

iii

“the trunk road” means the A30 Trunk Road.

The length of the trunk road described in the Schedule to this Order shall cease to be a trunk road and shall be classified as a classified road from the date on which the Secretary of State notifies the Cornwall County Council that the new trunk roads are open for traffic.

THE SCHEDULELENGTH OF THE TRUNK ROAD CEASING TO BE A TRUNK ROAD

The length of the trunk road ceasing to be a trunk road is a section of the A30 for a distance of about 10.1km (6.3 miles) from the western end of Bodmin Bypass, in the area of Innis Downs Junction, to the eastern end of Indian Queens Bypass at a point about 70 metres southwest of the access to Trewin Farm (marked A on the plan) and is shown by broad black dashes on the plan numbered HA10/OD/454, marked “The A30 Trunk Road (Bodmin to Indian Queens Improvement and Slip Roads) (Detrunking) Order 200.” signed by authority of the Secretary of State for Transport, and deposited at the ODPM-DfT Records Management Branch, Floor 13 (IMD), Ashdown House, St Leonards on Sea, Hastings, East Sussex TN37 7GA.
