The Secretary of State, in exercise of the powers conferred upon him by sections 15(1) and 80 of the Health and Safety at Work etc. Act 1974(1)—

(a)

for the purposes of giving effect to proposals submitted to him by the Health and Safety Commission under section 11(2)(d) of the 1974 Act after the carrying out by the said Commission of consultations in accordance with section 50(3) of that Act; and

(b)

it appearing to him that the modifications in regulation 2 are expedient and it also appearing to him that there are no bodies to consult in respect of such modifications in accordance with section 80(4) of the 1974 Act,

hereby makes the following Regulations:

Citation and commencement

1.  These Regulations may be cited as the Railways and Other Guided Transport Systems (Safety) (Amendment) Regulations 2006 and shall come into force as respects all regulations except for regulation 2(3) on 10th April 2006 and as respects regulation 2(3) on 1st October 2006.

Amendment of the Railways and Other Guided Transport Systems (Safety) Regulations 2006

2.—(1) Paragraph 4 of Schedule 6 to the Railways and Other Guided Transport Systems (Safety) Regulations 2006(2) shall be amended as follows.

(2) After sub-paragraph (2) add—

(a)at the end, add “Parts 2 and 3 of the Railways and Other Guided Transport Systems (Safety) Regulations 2006.”;.

(3) After sub-paragraph (2)(a) add—

(b)omit “Railways (Safety Case) Regulations 2000.”..

Explanatory Note

(This note is not part of the Regulations)

These Regulations amend the Railways and Other Guided Transport Systems (Safety) Regulations 2006 (S.I. 2006/599). The effect of the amendment is to include an amendment to Schedule 4 to the Enterprise Act 2002 (Part 9 Restrictions on Disclosure of Information) (Amendment and Specification) Order 2003 (S.I. 2003/1400) which from the 1st October 2006 omits from that Schedule reference to the Railways (Safety Case) Regulations 2000 (S.I. 2000/2688) and from 10th April 2006 adds reference in that Schedule to Parts 2 and 3 of the Railways and Other Guided Transport Systems (Safety) Regulations 2006.

1974 c. 37; section 15 was amended by the Employment Protection Act 1975 (c. 71), section 116 and Schedule 15, paragraphs 6 and 16 respectively; the general purposes of Part I referred to in section 15(1) were extended by section 117 of the Railways Act 1993 c. 43; section 15(1) was amended by S.I. 2002/794, article 5(2) and Schedule 2; Sections 80(4) and (5) were substituted for subsections (4) to (6) as originally enacted by the Employment Protection Act 1975, section 116 and Schedule 15, paragraph 19; section 80(4) was amended by S.I. 2002/794, article 5(2) and Schedule 2; there are amendments to the Act not relevant to these Regulations.
