Penalties: Guernsey10.
(1)
This article applies to a person guilty of an offence in Guernsey.
(2)
A person guilty of an offence under article 3, 4 or 6 is liable—
(a)
on conviction on indictment, to imprisonment for a term not exceeding seven years or to a fine or to both; or
(b)
on summary conviction, to imprisonment for a term not exceeding six months or to a fine not exceeding level 5 on the standard scale or to both.
(3)
A person guilty of an offence under article 8(7) or (8) or under paragraph 4(b) or (d) of the Schedule is liable—
(a)
on conviction on indictment, to imprisonment for a term not exceeding two years or to a fine or to both; or
(b)
on summary conviction, to imprisonment for a term not exceeding six months or to a fine not exceeding level 5 on the standard scale or to both.
(4)
A person guilty of an offence under paragraph 2(3) or 4(a) or (c) of the Schedule is liable on summary conviction to imprisonment for a term not exceeding six months or to a fine not exceeding level 5 on the standard scale or to both.
