Except as provided in paragraph (2), these Regulations apply in relation to a person who has attained the qualifying age for state pension credit.

These Regulations shall not apply in relation to any person if he or, if he has a partner, his partner, is a person on income supportF1, an income-based jobseeker's allowance or on an income-related employment and support allowance .
