Special provisions relating to compliance noticesE+W

14.—(1) The local authority shall give the Secretary of State (in England) and the [F1Welsh Ministers] (in Wales) on demand such information as the Secretary of State, or as the case may be, the [F1Welsh Ministers] requires in order to exercise any function under regulation 10.

(2) Paragraph (3) applies where—

(a)the Secretary of State, or as the case may be, the [F1Welsh Ministers] considers that a person served with a notice under regulation 10(2) has failed to comply with the requirements of the notice;

(b)the Secretary of State, or as the case may be, the [F1Welsh Ministers] requires the local authority to ascertain whether there has been such a failure; and

(c)the local authority fails to comply with the requirement.

(3) Where this paragraph applies—

(a)the Secretary of State, or as the case may be, the [F1Welsh Ministers] may appoint a person to ascertain whether a person served with a notice under regulation 10(2) has failed to comply with the requirements of the notice;

(b)a person so appointed is deemed to be an inspector; and

(c)the costs incurred by the Secretary of State or the [F1Welsh Ministers] in connection with ascertaining whether there has been such a failure are recoverable on demand from the local authority.
