The Secretary of State for Work and Pensions makes the following Regulations in exercise of the powers conferred by sections 8(3)(h), 79(1) and 84 of the Social Security Act 1998(1).
In accordance with section 173(1)(b) of the Social Security Administration Act 1992(2), the Secretary of State has obtained the agreement of the Social Security Advisory Committee that proposals in respect of these Regulations need not be referred to it.
1.—(1) These Regulations may be cited as the Social Security Act 1998 (Prescribed Benefits) Regulations 2006 and shall come into force on 16th October 2006.
2. The benefits prescribed for the purposes of section 8(3)(h) of the Social Security Act 1998 (decisions by Secretary of State) are—
(a)the following benefits under the Social Security Act 1975(3)—
(i)sickness benefit under section 14;
(ii)unemployment benefit under section 14;
(iii)invalidity pension under section 15;
(iv)invalidity allowance under section 16;
(v)attendance allowance under section 35; and
(vi)mobility allowance under section 37A;
(b)supplementary benefit under the Supplementary Benefit Act 1976(4).

These Regulations prescribe benefits for the purposes of the definition of “relevant benefit” under section 8(3) of the Social Security Act 1998.
A full regulatory impact assessment has not been carried out as these Regulations do not impose a cost on business, charities or the voluntary sector.
1998 c.14. Section 84 is cited for the meaning there given to “prescribe”.
1975 c.14. Sections 35 and 37A were repealed by the Disability Living Allowance and Disability Working Allowance Act 1991 (c.21) and section 14 to 16 were consolidated in the Social Security Contributions and Benefits Act 1992 (c.4).
1976 c.71. This Act was repealed by the Social Security Act 1986 (c.50), Schedule 11.
