SCHEDULE 3 Amendments of the Teachers’ Pensions Regulations 1997

Interest on late payment of certain benefits

55.  In regulation E34—

(a) in paragraph (1) after “pension payable under” insert “regulation E4A or”,

(b) after paragraph (4) insert—

“(4A) Where, pursuant to regulation E13A(5) a total incapacity pension is payable again as from the date on which the person took up employment the person shall, for the purposes of this regulation, be treated as having become entitled to the total incapacity pension again on the date on which the Secretary of State determines that the person still meets the condition specified in regulation E8A(2)(a).”
