PREVENTION AND SUPPRESSION OF TERRORISM

This Order is made in exercise of the powers conferred by section 13(2)(c) of the Prevention of Terrorism Act 2005(1).

The Secretary of State has consulted the person appointed for the purposes of section 14(2) of that Act, the Intelligence Services Commissioner and the Director-General of the Security Service about the making of this instrument.

In accordance with section 13(4) of that Act, a draft of this instrument was laid before Parliament and approved by a resolution of each House of Parliament.

Accordingly, the Secretary of State makes the following Order:

Citation and commencement

1.  This Order may be cited as the Prevention of Terrorism Act 2005 (Continuance in force of sections 1 to 9) Order 2006 and shall come into force on 11th March 2006.

Continuance in force of sections 1 to 9 of the Prevention of Terrorism Act 2005

2.  Sections 1 to 9 of the Prevention of Terrorism Act 2005 shall not expire in accordance with section 13 (1) of that Act but shall continue in force for a period of one year beginning with 11th March 2006.

Explanatory Note

(This note is not part of the Order)

This Order continues in force for a period of one year, beginning with 11th March 2006, sections 1 to 9 of the Prevention of Terrorism Act 2005, which would otherwise expire at the end of 10th March 2006 pursuant to section 13(1) of that Act.

These provisions enable the Secretary of State to make a control order against an individual where he has reasonable grounds for suspecting that individual is or has been involved in terrorism-related activity and it is necessary to impose obligations on that individual for purposes connected with protecting members of the public from a risk of terrorism.
