SCHEDULE AMENDMENT OF ENACTMENTS

Amendments to the Railways (Safety Case) Regulations 2000

9.  In regulation 2(1) of the Railways (Safety Case) Regulations 2000(1) (interpretation), for the definition of “the Executive” substitute—

““the Executive” means—

(a)

except in regulation 16, the Office of Rail Regulation where it is made the enforcing authority in relation to the operation of a railway by regulation 3(1) of the Health and Safety (Enforcing Authority for Railways and Other Guided Transport Systems) Regulations 2006; and

(b)

the Health and Safety Executive in any other case and in regulation 16;”.
