This Order brings into force, on 6th April 2006, Part 7 of Schedule 5 to the Civil Partnership Act 2004 (c. 33) (“the Act”). Part 7 provides for the court to have regard to pension protection fund compensation when considering the question of financial relief on the dissolution or annulment of a civil partnership or on the legal separation of civil partners. It also brings into force certain paragraphs of Schedule 7 to the Act which make similar provision where a civil partnership is dissolved or annulled or civil partners have been legally separated overseas and an application for financial relief is made in England and Wales. The Pension Protection Fund was established by the Pensions Act 2004 (c. 35) (“the Pensions Act”). It pays compensation to members of certain pension schemes when a qualifying insolvency event in relation to the employer occurs and where there are insufficient assets in the pension scheme to cover the levels of compensation which would be payable by the Pension Protection Fund under the Pensions Act.
