EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations, which apply in relation to England, further amend the National Health Service (Functions of Strategic Health Authorities and Primary Care Trusts and Administration Arrangements) (England) Regulations 2002 (“the principal Regulations”).

Regulation 4 amends the principal Regulations so that the Secretary of State’s function of determining travelling and other allowances payable to members of committees of Primary Care Trusts is exercisable (1) by Strategic Health Authorities, for performance management purposes specified in regulation 3(2) of the principal Regulations, and (2) by Primary Care Trusts. By regulation 3 the function is exercisable only in relation to members of Executive Committees of Primary Care Trusts.

A full regulatory impact assessment has not been produced for this instrument as no impact on the private or voluntary sectors is foreseen.
