Amendment of the Community Design Regulations 2005
3.—(1) The Community Design Regulations 2005(1) are amended as follows.
(2) In regulation 1 (introductory and interpretation)—
(a)in paragraph (2)—
(i)after “Council Regulation (EC) 6/2002 of 12th December 2001 on Community Designs;”, omit “and”, and
(ii)at the end insert “; and “international registration” has the same meaning as in Articles 106a to 106f of the Community Design Regulation”; and
(b)after paragraph (2) insert—
“(3) In addition, references to a Community design and a registered Community design include a reference to a design protected by virtue of an international registration designating the Community.”.
(3) In regulation 2, after paragraph (6) insert—
“(6A) In relation to a design protected by virtue of an international registration designating the Community, the reference in paragraph (3) to a registration being invalid includes a reference to the effects of the international registration being declared invalid in accordance with Article 106f of the Community Design Regulation.”.
