The Supply of Information (Register of Deaths) (Northern Ireland) Regulations 2007

The Secretary of State in exercise of the powers conferred by sections 13(1)(d) and 49 of the Police and Justice Act 2006(1), after consulting the Registrar General for Northern Ireland, makes the following Regulations:

Citation, Commencement and interpretation

1.—(1) These Regulations may be cited as the Supply of Information (Register of Deaths) (Northern Ireland) Regulations and shall come into force on 1st January 2008.

(2) Reference to the Registrar General means the Registrar General for births, deaths, marriages, and civil partnerships in Northern Ireland.

(3) Reference to information is information contained in any register of deaths held by the Registrar General.

(4) List Cleaning means updating lists so as to remove the entries on those lists of persons who are deceased.

Disclosure of information

2.  The Registrar General may supply information to the person or body specified or of a description specified in the Schedule.

SCHEDULE

1.  A local authority within the meaning of the Local Government Act 1972.

2.  A local authority within the meaning of the Local Government (Wales) Act 1994.

3.  The Council of the Isles of Scilly.

4.  A council within the meaning of the Local Government etc (Scotland) Act 1994.

5.  A district council within the meaning of the Local Government Act (Northern Ireland) 1972.

6.  A government department in England and Wales and any agency thereof.

7.  A government department in Scotland and any agency thereof.

8.  A government department in Northern Ireland and any agency thereof.

9.  A credit reference agency that provides factual information so that lenders can make decisions regarding credit.

10.  A building society within the meaning of the Building Societies Act 1986.

11.  An insurance company within the meaning of the Finance Act 2004.

12.  Any person or body offering goods or services on credit or lending money to customers under the Consumer Credit Act 1974.

13.  Banks as defined in the Income Tax Act 2007.

14.  The trustees or managers of a pension scheme.

15.  Any person or body undertaking list cleaning as defined in these regulations.

16.  A public body, not being a government department, which is a non-departmental public body established by an Act of Parliament or by a statutory instrument made under an Act of Parliament to perform functions conferred on it under or by that Act or instrument or any other Act or instrument; or a body to whom Ministerial functions have been contracted out under the Deregulation and Contracting Out Act 1994.

17.  A health service body as defined in section 4(2) of the National Health Service and Community Care Act 1990.

18.  A body to which Article 90 of the Health and Personal Social Services (Northern Ireland) Order 1972 applies.

19.  The City of London.

These Regulations permit the Registrar General for Births, Deaths, Marriages and Civil Partnerships in Northern Ireland to supply information contained in any register of deaths held by the Registrar General, to any person or body specified or of a description specified in the schedule to these regulations.
