Revocation and savings22.

(1)

Subject to paragraphs (2) and (3), the Compulsory Purchase by Non-Ministerial Acquiring Authorities (Inquiries Procedure) Rules 19908 (“the 1990 Rules”) and the Compulsory Purchase by Ministers (Inquiries Procedure) Rules 19949 (“the 1994 Rules”) are revoked.

Where on the date on which these Rules come into force the Secretary of State, in accordance with rule 4(a) of the 1990 Rules, or the Minister, in accordance with rule 4 of the 1994 Rules, has given written notice of his intention to hold an inquiry, the 1990 Rules, or, as the case may be, the 1994 Rules shall continue to apply in relation to any inquiry which is caused to be held in England or Wales pursuant to that notice.

Where the Welsh Ministers are the authorising authority, the 1990 Rules or, as the case may be, the 1994 Rules shall continue to apply.
