Subject to paragraph (2), the Sulphur Content of Liquid Fuels (England and Wales) Regulations 2000 are revoked.

Where an operator of a combustion plant—
a
has submitted an application for a sulphur content of liquid fuels permit in accordance with Schedule 1 to those Regulations; and
b
the application has not been determined at the date these Regulations come into force,
the application shall continue to be determined under those Regulations.
