9.—(1) Paragraph (2) applies to all buildings in relation to which the Building Regulations [F12010] do not apply, other than—

(a)buildings which are exempt from those Regulations by virtue of regulation [F221] of those Regulations;

(2) When a building is constructed the relevant person shall, no later than five days after the construction work has been completed, give to the owner of the building an energy performance certificate for the building.
