The Secretary of State for Transport makes the following Regulations in exercise of the powers conferred by sections 45(1) and 67 of the Disability Discrimination Act 1995(1).

In accordance with section 45(4) of that Act she has consulted such representative organisations as she thinks fit.

Citation and commencement

1.  These Regulations may be cited as the Public Service Vehicles Accessibility (Amendment) Regulations 2008 and shall come into force on 13th July 2008.

Increases in fees

2.—(1) The Public Service Vehicles Accessibility Regulations 2000(2) shall be amended as follows.

(2) In the regulations specified in column (1) of the Table below, for each amount specified in column (2) substitute the amount specified in column (3).

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the Public Service Vehicles Accessibility Regulations 2000 (“the 2000 Regulations”). The 2000 Regulations apply to single-deck and double-deck buses, and to single-deck and double-deck coaches, where such vehicles are used to provide local and scheduled services and have a capacity of more than twenty-two passengers.

The fees for accessibility certificates, approval as type vehicles, conformity certificates and duplicate certificates are specified in regulations 7, 12, 17 and 18 of the 2000 Regulations. Regulation 2 amends the prescribed fees, which are set out in the Table below. The percentage increases since the fees were last fixed are shown in brackets.

Application for approval of a vehicle as a type vehicle of a vehicle that conforms substantially to a vehicle already approved as a type vehicle or has a chassis or body that conforms to the chassis or body of a vehicle already approved as a type vehicle—
(a) where the vehicle is required to comply with only one of Schedules 1, 2 or 3.	160	168 (5%)
(b) where the vehicle is required to comply with either Schedules 1 and 2 or Schedules 1 and 3.	320	336 (5%)
Application for approval of a vehicle as a type vehicle of a vehicle that conforms substantially to a vehicle already approved as a type vehicle, the Secretary of State is satisfied that the vehicle conforms (except in unimportant details) to a vehicle already approved as a type vehicle, and no inspection of the vehicle is made—
(a) where the vehicle is required to comply with only one of Schedules 1, 2 or 3, or	15	16 (6.7%)
(b) where the vehicle is required to comply with either Schedules 1 and 2, or Schedules 1 and 3.	30	32 (6.7%)
Application for approval of a vehicle as a type vehicle if a vehicle has a body and a chassis which has formed parts of different vehicles which have already been approved as type vehicles—
(a) where the vehicle is required to comply with only one of Schedules 1, 2 or 3, or	79	83 (5.1%)
(b) where the vehicle is required to comply with either Schedules 1 and 2, or Schedules 1 and 3.	158	166 (5.1%)
Application for approval as a type vehicle in any other case—
(a) where the vehicle is required to comply with only one of Schedules 1, 2 or 3, or	350	368 (5.1%)
(b) where the vehicle is required to comply with either Schedules 1 and 2, or Schedules 1 and 3.	690	725 (5.1%)
Issue of a conformity certificate	15	16 (6.7%)
Issue of duplicate accessibility or conformity certificate	11	12 (9.1%)
