Amendment of Schedule 9A27

Schedule 9A M1 (deductions of mortgage interest from benefit and payment to qualifying lenders) is amended as follows.

In paragraph 1 (interpretation) in the definition of “relevant benefits”M2—

a

after paragraph (c) omit “and”; and

b

after paragraph (d) add—

and

e

income-related employment and support allowance;

In paragraph 2(a) M3 (specified circumstances for the purposes of regulation 34A) after sub-paragraph (iii) add—

In paragraph 3 (specified part of relevant benefit)—

a

in sub-paragraph (1) M4 after “Jobseeker's Allowance Regulations” add “ or, in the case of employment and support allowance, a sum equal to the amount of mortgage interest to be met in accordance with paragraphs 8 to 11 of Schedule 6 to the Employment and Support Allowance Regulations ”; and

b

in sub-paragraph (3) M5—

i

for “or income-based jobseeker's allowance” substitute “ income-based jobseeker's allowance or income-related employment and support allowance ”;

ii

in paragraph (b) after “Jobseeker's Allowance Regulations” insert “ or paragraph 6(10) or (13) or 19 of Schedule 6 to the Employment and Support Allowance Regulations ”;

iii

in the definition of “A” after “Jobseeker's Allowance Regulations” add “ or paragraph 1 of Schedule 6 to the Employment and Support Allowance Regulations ”;

iv

v
