The Secretary of State makes the following Order in exercise of the power conferred by section 7(3)(a) of the Freedom of Information Act 2000(1), and having consulted the Presiding Officer of the National Assembly for Wales(2) in accordance with section 7(4)(a) of that Act(3).
A draft of this Order was laid before Parliament and approved by a resolution of each House of Parliament in accordance with section 82(2)(a) of that Act.
2000 c.36. The functions of the Lord Chancellor under section 7 were transferred to the Secretary of State by the Secretary of State for Constitutional Affairs Order 2003 (S.I. 2003/1887). Those functions had previously been transferred to the Lord Chancellor by the Transfer of Functions (Miscellaneous) Order 2001 (S.I. 2001/3500), which Order amended that section accordingly.
Section 7(4)(a) of the Freedom of Information Act 2000 requires the Secretary of State to consult the Presiding Officer of the National Assembly for Wales before making an order under section 7(3) that relates to the National Assembly for Wales.
