By the Lords of Her Majesty’s Most Honourable Privy Council
Their Lordships make the following Order of Council in exercise of the powers conferred by articles 1(5) and 6(1) of the Health Care and Associated Professions (Miscellaneous Amendments) Order 2008(1).
1.—(1) This Order may be cited as the Health Care and Associated Professions (Miscellaneous Amendments) Order 2008 (Commencement No. 1) Order of Council 2008.
(2) In this Order, “the principal Order” means the Health Care and Associated Professions (Miscellaneous Amendments) Order 2008.
2.—(1) 3rd November 2008 is the day appointed for the coming into force of—
(a)paragraphs 3 to 8, 16, 17, 19 and 22 of Schedule 1 to the principal Order, and article 2(1) of the principal Order in so far as it relates to those paragraphs; and
(b)article 3(1) of, and Part 1 of Schedule 5 to, the principal Order.
(2) 1st January 2009 is the day appointed—
(a)for the coming into force of—
(i)paragraphs 1 and 21 of Schedule 1 to the principal Order, in so far as not already in force,
(ii)paragraphs 18 and 20(b) of Schedule 1 to the principal Order, and
(iii)article 2(1) of the principal order, in so far as it relates to those paragraphs; and
(b)for the coming into force of paragraph 2 of Schedule 5 to the principal Order, and article 3(2) of the principal Order in so far as it relates to that paragraph.
3. On and after 1st January 2009 and until the coming into force of paragraph 10 of Schedule 1 to the Medical Act 1983 (Amendment) Order 2002(2) (which substitutes the definition of “registered medical practitioner” in the Interpretation Act 1978(3) for a new definition encompassing the holding of a licence to practise), paragraph 1A of Schedule 1 to the Medical Act 1983(4) (which relates to membership of the General Medical Council) shall apply as if sub-paragraph (1)(a)(ii) were omitted.

This Order brings into force, on 3rd November 2008, the provisions of the Health Care and Associated Professions (Miscellaneous Amendments) Order 2008 that relate to changes to the system for the approval of providers of primary United Kingdom medical qualifications. These changes include the establishment of a new list of approved providers, which is to be kept by the General Medical Council (“GMC”). It also brings into force, on 1st January 2009, the new governance arrangements for the GMC that are set out in that Order. The principal change is the change from a Council that has a mix of elected medical, nominated medical and appointed lay members to a Council that is fully appointed, the constitution of which is now to be set out in a separate Order of the Privy Council. There is a transitional provision that ensures that medical members of the GMC need not hold licences to practise until those have been introduced.
