EXPLANATORY NOTE

(This note is not part of the Order)

This Order is the first commencement order made under the Forced Marriage (Civil Protection) Act 2007 (“the Act”).

The Order brings the following provisions of the Act into force on 25th November 2008: section 1, except in so far as it provides for section 63N (power to extend jurisdiction to magistrates’ courts) to be inserted into the Family Law Act 1996; section 3(1), in so far as it relates to Part 1 of Schedule 2 (except for paragraph 3(3) of that Part); and Part 1 of Schedule 2, except for paragraph 3(3) of that Part. As so commenced, section 1 inserts new Part 4A (Forced Marriage), less section 63N, into the Family Law Act 1996; and section 3(1) and Part 1 of Schedule 2 give effect to consequential amendments to the law of England and Wales, save for consequential amendments relating to section 63N.
