5. In relation to employment which commenced before 29th February 2008, including employment which continued on or after that date, section 28AA (arrest with warrant)(1) and section 28FA(2) (power to search business premises)(2) of the Immigration Act 1971 shall continue to have effect in respect of an offence under section 8 of the Asylum and Immigration Act 1996 (restrictions on employment)(3).
Section 28AA of the Immigration Act 1971 (c. 77) was inserted by section 152 of the Nationality, Immigration and Asylum Act 2002 (c. 41) and has since been amended by section 27 of the 2007 Act.
Section 28FA was inserted into the Immigration Act 1971 by section 154 of the Nationality, Immigration and Asylum Act 2002 and has since been amended by section 28 of the 2007 Act.
1996 c. 49. Section 8 of the 1996 Act is repealed by section 21 of the Immigration, Asylum and Nationality Act 2006 but will continue to have effect in relation to employment which commenced before 29th February 2008 (including employment which continued on or after that date): the Immigration, Asylum and Nationality Act 2006 (Commencement No. 8 and Transitional and Saving Provisions) Order 2008 (S.I. 2008/—).
