Her Majesty, in exercise of the powers conferred upon Her by section 108 of the Civil Aviation Act 1982(1), is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows:

Citation and commencement

1.  This Order may be cited as the Civil Aviation (Overseas Territories) (Gibraltar) (Revocations) (No. 2) Order 2008 and comes into force on such day as the Governor of Gibraltar may appoint by proclamation published in the Gibraltar Gazette.

Revocation of the Civil Aviation Act 1949 (Overseas Territories) Order 1969

2.  The Civil Aviation Act 1949 (Overseas Territories) Order 1969(2) is revoked insofar as it applies to Gibraltar.

Revocation of the Civil Aviation Act 1971 (Overseas Territories) Order 1976

3.  The Civil Aviation Act 1971 (Overseas Territories) Order 1976(3), which has been revoked in respect of its application to certain territories other than Gibraltar, is now also revoked in respect of its application to Gibraltar.

Revocation of the Civil Aviation Act 1982 (Overseas Territories) (No. 2) Order 2001

4.  The Civil Aviation Act 1982 (Overseas Territories) (No 2) Order 2001(4) is revoked insofar as it applies to Gibraltar.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order revokes the Civil Aviation Act 1949 (Overseas Territories) Order 1969 and the Civil Aviation Act 1982 (Overseas Territories) (No. 2) Order 2001 insofar as they apply to Gibraltar. The Civil Aviation Act 1971 (Overseas Territories) Order 1976 which was revoked by the Civil Aviation Act 1982 (Overseas Territories) Order 2001 (S.I. 2001/1452) in respect of its application to certain territories other than Gibraltar, is now also revoked in respect of its application to Gibraltar. This Order is necessary to avoid a conflict that would otherwise occur when civil aviation legislation in Gibraltar comes into force; that legislation will govern the aspects of civil aviation in Gibraltar currently covered by these Orders.

An impact assessment has not been produced for this instrument as no impact on the private or voluntary sectors is foreseen.
