The Secretary of State makes the following Order in exercise of the powers conferred by sections 59(2) and (3)(a) of the UK Borders Act 2007(1).
1. This Order may be cited as the UK Borders Act 2007 (Commencement No. 5) Order 2008.
2. The following provisions of the UK Borders Act 2007 shall come into force on 6th January 2009 —
(a)section 21 (children);
(b)for all remaining purposes, section 51 (Border and Immigration Inspectorate: plans); and
(c)for all remaining purposes, sections 52 and 53 (Border and Immigration Inspectorate: relationship with other bodies).

This Order brings into force on 6th January 2009 section 21 of the UK Borders Act 2007 which concerns the issuing of a code of practice, designed to ensure that in exercising functions, the Border and Immigration Agency takes appropriate steps to ensure that while children are in the UK, they are safe from harm. On the same date, this Order also brings into force sections 51, 52 and 53 of the Act for all remaining purposes. These provisions concern the Chief Inspector of the Border and Immigration Agency.
