The Secretary of State, in exercise of the powers conferred by section 153(4) of the Environmental Protection Act 1990(1), makes the following Order:
1990 c. 43. The relevant functions of the Secretary of State so far as they are exercisable in relation to Scotland were transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act 1998 (c. 46). In relation to Wales, the Secretary of State has concurrent powers with the Welsh Ministers: see article 2 of, and the entry relating to the Environmental Protection Act 1990 in Schedule 1 to the National Assembly for Wales (Transfer of Functions) Order 1999 (S.I. 1999/672) and paragraphs 30 to 32 of Schedule 11 to the Government of Wales Act 2006 (c. 32).
