The Education (School Performance Information) (England) (Amendment) Regulations 2008

The Secretary of State for Children, Schools and Families makes the following Regulations in exercise of the powers conferred by sections 537, 537A and 569(4) of the Education Act 1996().
Citation, commencement and application
1.—(1) These Regulations may be cited as the Education (School Performance Information) (England) (Amendment) Regulations 2008 and come into force on 1st April 2008.
(2) These Regulations apply only in relation to England.
Amendment of the Education (School Performance Information) (England) Regulations 2007
2.—(1) The Education (School Performance Information) (England) Regulations 2007() are amended as follows.
(2) In paragraph 2(2)(f) of Schedule 3, after “administered” insert “and (if so) the reason for the absence”.

EXPLANATORY NOTE
These regulations amend the Education (School Performance Information) (England) Regulations 2007 so as to provide for schools to supply to the Secretary of State, on receipt of a written request, the reason for the absence of a pupil from a Key Stage 3 National Curriculum test.
