4. The relevant date required(1) to be specified in a section 53A Order which includes provision made by virtue of section 53A(2) of the Act is the date upon which the stopping up (also referred to as the extinguishment), diversion or, as the case may be, creation of the path effected by that Order comes fully into effect.
The requirement is contained in section 56(3A) of the Wildlife and Countryside Act 1981 (inserted by section 51 of, and paragraph 6(6) of Schedule 5 to, the 2000 Act). The “relevant date” is the date on which the provisions of the section 53A Order take effect: see section 53A(6).
