The Secretary of State for Transport, with the consent of the Treasury, makes the following Regulations in exercise of the powers conferred by section 56(1) and (2) of the Finance Act 1973 M1.

1.  These Regulations may be cited as the Vehicle Drivers (Certificates of Professional Competence) (Amendment) Regulations 2008 and come into force on 1st April 2008.

Amendment of the 2007 RegulationsU.K.

2.—(1) Regulation 6 (persons providing periodic training courses) of the Vehicle Drivers (Certificates of Professional Competence) Regulations 2007 M2 is amended as follows.

(2) In paragraph (1), for subparagraph (b) substitute—

(b)for each course which he proposes to provide, a sum equal to £36 multiplied by the proposed duration of the course in hours and for this purpose part of an hour shall be treated as one hour..

(3) After paragraph (1), add—

(1A) The competent authority may waive the fee in paragraph (1) or (8) in whole or part if it thinks fit..

(4) In paragraph (8), for “a fee of £250” substitute “ the fee prescribed in paragraph (1)(b) ”.

Explanatory Note

(This note is not part of the Regulations)

These Regulations amend The Vehicle Drivers (Certificates of Professional Competence) Regulations 2007 (“the principal regulations”). The principal regulations implemented Council Directive 2003/59/EC of the European Parliament and of the Council of 15 July 2003 on the initial qualification and periodic training of drivers of certain road vehicles for the carriage of goods or passengers (OJ No. L 226, 10.9.2003, p.4).

Regulation 2(2) alters the charging basis for the fee for application for approval for a periodic training course. Under regulation 6 of the principal regulations a fee of £250 is payable for each course. Under regulation 2(2) that fee is changed to a fee of £36 per hour or part hour of each course being approved. Regulation 6 of the principal regulations also provides for a fee of £1500 to be payable for approval as a course provider. Regulation 2(3) further amends regulation 6 to provide a power for this fee and the fee payable for individual courses to be waived in whole or in part.
