The Secretary of State, in exercise of the power conferred by section 13(1)(d) of the Police and Justice Act 20061, after consulting the Registrar General for Northern Ireland, makes the following Order:

Citation commencement and interpretation1

This Order may be cited as the Supply of Information (Register of Deaths) (Northern Ireland) Order 2008 and shall come into force on 8th April 2008.

In this Order “insurer” means a person who has permission under Part IV of the Financial Services and Markets Act 20002 to effect or carry out contracts of insurance.

The definition of insurer in paragraph (2) must be read with —

a

section 22 of the Financial Services and Markets Act 2000;

b

any relevant order under that section; and

c

Schedule 2 to the Act.

Revocation2

The Supply of Information (Register of Deaths) Regulations 20073 are revoked.

Disclosure of information3

The Registrar General for Northern Ireland may supply information contained in any register of deaths kept by the Registrar General to a person or body specified, or of a description specified, in the Schedule to this Order for use in the prevention, detection, investigation or prosecution of offences.

The Council of the Isles of Scilly.

A council within the meaning of the Local Government etc. (Scotland) Act 19945.

A government department in England and Wales and any agency thereof.

A government department in Scotland and any agency thereof.

The Scottish Executive.

A Northern Ireland department.

A credit reference agency.

A building society within the meaning of the Building Societies Act 19867.

An insurer.

A person who holds a licence under the Consumer Credit Act 19748.

A bank as defined in the Bankers’ Books Evidence Act 18799.

The trustees or managers of a pension scheme.

A person who, or body which, updates lists so as to remove the entries on those lists of persons who are deceased.

A body established by an Act of Parliament or by a statutory instrument made under an Act of Parliament to perform functions conferred on it under or by that Act or instrument.

An NHS body within the meaning of the National Health Service Act 200610.

An NHS body within the meaning of the National Health Service (Wales) Act 200611.

A body to which Article 90 of the Health and Personal Social Services (Northern Ireland) Order 1972 applies12.

The Common Council of the City of London.

A person who has been authorised to exercise a function of an office-holder or Minister in accordance with section 69 of the Deregulation and Contracting Out Act 199413.

A person who has been authorised to exercise a function of a local authority in accordance with section 70 of the Deregulation and Contracting Out Act 1994.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order permits the Registrar General for Northern Ireland to supply information contained in any register of deaths held by the Registrar General to a person or body specified or of a description specified in the Schedule to this Order for use in the prevention, detection, investigation or prosecution of offences.

This Order revokes S.I. 2007/3390, which was defective.
