For regulation 3, substitute—

“The competent authority3.

The Secretary of State is the competent authority for the purposes of the principal Regulation in its application to—

(a)

England, Wales and Scotland;

(b)

offshore installations; and

(c)

in relation to importation, Northern Ireland.

Appointment of authorised persons3A.

The enforcing authority may authorise in writing such persons (“authorised persons”) as they consider appropriate for the purpose of enforcing these Regulations.”.
