Her Majesty, in exercise of the powers conferred by section 4(2) of the Parliamentary Commissioner Act 19671, is pleased, by and with the advice of Her Privy Council, to make the following Order:

Citation, commencement and interpretation1

This Order may be cited as the Parliamentary Commissioner Order 2009 and comes into force on 24th August 2009.

In this Order “the Act” means the Parliamentary Commissioner Act 1967.

Amendment to Schedule 2 to the Act2

In Schedule 2 to the Act2 (Departments etc. subject to investigation)—

a

insert the following entries in the appropriate place—

Board of the Pension Protection Fund.

Department for Business, Innovation and Skills.

Official receiver

Probation trusts.

insert the following note after the general note—

Board of the Pension Protection Fund

In the case of the Board of the Pension Protection Fund, an investigation may be conducted only in respect of action in connection with its functions relating to the financial assistance scheme established by regulations under section 286(1) of the Pensions Act 20043.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order amends the Parliamentary Commissioner Act 1967 (‘the Act’). This Order adds to Schedule 2 to the Act (Departments etc. subject to investigation) the bodies listed in article 2. The addition of the Board of the Pension Protection Fund is subject to a note, which provides that an investigation may be conducted only in respect of its functions relating to the financial assistance scheme.

A full impact assessment has not been produced for this instrument as no impact on the private or voluntary sectors is foreseen.
