4.  In section 41 (appeals to the Secretary of State under Part 3)—

(a) in the heading for “Secretary of State” substitute “First-tier Tribunal”;

(b) in subsection (1) for “Tribunal” substitute “First-tier Tribunal”; and

(c) omit subsections (1A) to (1D).
