DEFENCE

This Order deals primarily with the powers of search and of seizure granted to the service police under Part 3 of the Armed Forces Act 2006 (“the Act”). The main provisions in Parts 2 and 3 of the Order are, subject to modifications, equivalent to certain provisions of the Police and Criminal Evidence Act 1984 (“ PACE”) relating to powers of entry, search and seizure.

Making of orders by judge advocates

Where the material consists of information stored in any electronic form—

a

an order under paragraph 5(a) shall have effect as an order to produce the material in a form in which it can be taken away and in which it is visible and legible or from which it can readily be produced in a visible and legible form; and

b

an order under paragraph 5(b) shall have effect as an order to give a service policeman access to the material in a form in which it is visible and legible.
