The Secretary of State makes the following Order in exercise of the powers conferred by sections 1, 5 and 7 of the Export Control Act 2002(1):
1. This Order may be cited as the Export of Objects of Cultural Interest (Control) (Amendment) Order 2009 and comes into force on 28th August 2009.
2. For the definition of “the Regulation” in article 1(2) of the Export of Objects of Cultural Interest (Control) Order 2003(2)substitute ““the Regulation” means Council Regulation (EC) No 116/2009 of 18 December 2008 on the export of cultural goods(3).”.

This Order amends the definition of “the Regulation” in article 1(2) of the Export of Objects of Cultural Interest (Control) Order 2003 (S.I. 2003/2759) by deleting the reference to Council Regulation (EEC) No. 3911/92 (“the 1992 Regulation”) and substituting a reference to Council Regulation (EC) No 116/2009 (“the codified Regulation”). The codified Regulation does not make any substantive change; it consolidates the provisions of the 1992 Regulation and the amendments made to the 1992 Regulation by Council Regulation (EC) No. 2469/96; Council Regulation (EC) No 947/2001 and Council Regulation (EC) No 806/2003.
