The Secretary of State, in exercise of the power conferred by paragraph 26(5) of Schedule 1 to the Criminal Justice and Immigration Act 20081, makes the following Order:

Citation, commencement and interpretation1

This Order may be cited as the Youth Rehabilitation Order (Electronic Monitoring Requirement) Order 2009 and shall come into force on 30 November 2009.

In this Order “the 2008 Act” means the Criminal Justice and Immigration Act 2008.

Persons responsible for monitoring2

The description of person responsible for the monitoring under a youth rehabilitation order with an electronic monitoring requirement, for the purposes of paragraph 26(5) of Schedule 1 to the 2008 Act (electronic monitoring requirement)—

a

where an offender to whom the requirement applies resides in a police area2 specified in Schedule 1, is a person employed to monitor offenders by Serco Group plc, Serco House, 16 Bartley Wood Business Park, Bartley Way, Hook, Hampshire RG27 9UY; and

b

where an offender to whom the requirement applies resides in a police area specified in Schedule 2, is a person employed to monitor offenders by G4S Care and Justice Services (UK) Limited, Sutton Park House, 15 Carshalton Road, Sutton, Surrey SM1 4LD.
