Further exception from requirement to tender for quality contracts

5.—(1) Section 130 of the Act does not apply in any case where the authority or authorities have issued invitations to tender in accordance with section 130 of the Act(1) (tendering for quality contracts) and either no tender, or no acceptable tender, is submitted in response to the invitation.
(2) The maximum duration of a quality contract entered into in the circumstances described in paragraph (1) is two years, commencing with the day on which services are first provided under the quality contract.
