This Order is made by Her Majesty in Council in exercise of the power conferred by section 87(7) of the Northern Ireland Act 1998(1).
Her Majesty considers it expedient to modify section 87(6) of that Act.
Accordingly Her Majesty, by and with the advice of Her Privy Council, makes the following Order:
1. This Order may be cited as the Northern Ireland Act 1998 (Modification) Order 2009 and comes into force on 20th May 2009.
2. In section 87(6) of the Northern Ireland Act 1998 at the end add—
“(v)the Child Maintenance and Other Payments Act 2008(2), the Mesothelioma, etc., Act (Northern Ireland) 2008(3), and the Child Maintenance Act (Northern Ireland) 2008(4);
(w)the Pensions Act 2008(5) and the Pensions (No. 2) Act (Northern Ireland) 2008(6).”.

This Order adds the Child Maintenance and Other Payments Act 2008, the Mesothelioma, etc., Act (Northern Ireland) 2008, the Child Maintenance Act (Northern Ireland) 2008, the Pensions Act 2008 and the Pensions (No. 2) Act (Northern Ireland) 2008 to the legislation listed in section 87(6) of the Northern Ireland Act 1998. The effect of this amendment will be to render those Acts subject to the provisions in that section concerning consultation and co-ordination between the Secretary of State and the Northern Ireland Minister having responsibility for social security.
